On a rigorous examination of expert evidence from a psychiatrist there was no basis for concluding that a defendant convicted of sexual assault on a child under 13 had been unfit to plead at the time of the trial. The psychiatrist had failed to address the criteria contained in R. v Pritchard 173 E.R. 135 when making his assessment.
