A judge had been entitled to conclude that an offender's rehabilitation had failed where he committed one offence of shoplifting and one of dwelling house burglary within five months of a community order being imposed for supplying Class A drugs. It had been open to the judge to revoke the community order and re-sentence the offender to nine months' imprisonment and a concurrent sentence of 18 months' imprisonment for the dwelling house burglary.
