The common law offence of causing a public nuisance had survived the effect of the Human Rights Act 1998 and an indictment for that offence was not in breach of Arts 7, 8 or 10 of the European Convention on Human Rights 1950 since the common law was sufficiently clear to enable a person, with legal advice if necessary, to foresee the consequences that his action might entail and to regulate his behaviour accordingly.
