The appropriate starting point for a category 2 burglary of a dwelling, committed whilst the offender was on licence for a second offence of burglary, was three years' imprisonment. The sentencing judge had correctly treated the fact that he was on licence at the time and had previous convictions for theft offences as factors taking the offence above the one-year starting point in the sentencing guidelines.
