A variation of sentence from 12 months to one of three years' detention was found to be excessive and disproportionate; the court ordered the appellant to be returned to custody pursuant to the Powers of Criminal Courts (Sentencing) Act 2000 s.116 for an unexpired licence period of 200 days before consecutively serving the sentence of 12 months for the offence of burglary and eight months for the offence of aggravated vehicle-taking, those two sentences to be concurrent with each other.
