A sentence would be varied where the effect of a sentence being reduced meant that the appellant would serve longer in prison than he would have done had his appeal been unsuccessful as a result of the 60-day home curfew scheme under the Criminal Justice Act 1991 as amended by the Crime and Disorder Act 1998.
