[2010] EWCA Crim 2935

In a case of alleged ill-treatment of persons in a residential care home who lacked capacity, a judge's direction to the jury as to the requisite elements of capacity under the Mental Capacity Act 2005 had been sufficient. He was not required to amplify his direction by referring to the provisions of s.3 of the Act.
