[2013] EWCA Crim 2494

A judge had erred in sentencing a young offender, who was 17 at the time of conviction, to detention in a young offender institution when, given his age, the only custodial sentences available were a detention and training order or detention under the Powers of Criminal Courts (Sentencing) Act 2000 s.91.
