The trial judge had not erred in failing to grant a stay of the prosecution since the appellant had not shown that a gap in video evidence had been a result of either the police or the prosecution deliberately seeking to mislead the court or frustrate the defence, and notwithstanding that gap a fair trial had still been possible.
