A judge was justified in giving a direction pursuant to the Criminal Justice and Public Order Act 1994 s.34 as at the trial the offender had attempted to give evidence on a matter that had not emerged during the course of his interview; the delay in his account entitled the judge to tell the jury to look closely at his evidence to see that it was not moulded to accord with the other evidence. The sentence was reduced as it was manifestly excessive.
