Where a defendant did not deny his presence at the scene of a crime but denied criminal participation, it was not necessary for an identification parade to be held in accordance with Code of Practice D Police and Criminal Evidence Act 1984. Fear of the regime to which the defendants might be deported and the additional hardship of serving their sentences in a foreign prison were not relevant to the sentencing exercise.
