The court reviewed the authorities on the circumstances in which an alternative verdict could be left to a jury. It distilled principles which it then applied to a case in which the defendants had been tried on the basis of the Offences against the Person Act 1861 s.18 but had argued that an alternative verdict under s.20 should have been left to the jury.
