The Lord Chancellor had no power under the Courts Act 2003 Sch.2 to effect a grant by a local authority of a lease of that part of a building which comprised a magistrates' court in circumstances where the magistrates' court was only part of that building. The Lord Chancellor could not compel a local authority to transfer the entirety of its freehold or leasehold interest in a building, part of which was a magistrates' court.
