[2012] EWHC 2525 (Admin)

The Crown Court had erred in increasing a sentence imposed for possession of an offensive weapon from 12 weeks' to six months' detention on appeal where the increased sentence was the maximum that could have been imposed by the magistrates' court, which meant that no credit had been given for the offender's guilty plea.
