The Serious Organised Crime and Police Act 2005 (Commencement No. 1, Transitional and Transitory Provisions) Order 2005 Arts.3(1)(p), 3(5) and 4(2), insofar as they purported to extend the application of the Serious Organised Crime and Police Act 2005 s.132(1) to continuing demonstrations that had commenced before s.132(1) of the Act had come into force, were ultra vires the enabling power in s.178(10) of the Act.
