The term "judicial authority" for the purposes of the Extradition Act 2003 and Decision 2002/584 was not confined to a judge who adjudicated but could extend to a body that prosecuted. The requirement in the Extradition Act 2003 s.2(3) for a European arrest warrant to state that the person was "accused" of the commission of an offence was satisfied even though the warrant did not formally state that the appellant was accused of an offence in Sweden and a decision had not been taken there to charge him and would only be taken after he had been questioned again.
