Whether the absence of legal representation at a sentencing hearing, due to inadequate remuneration within the legal aid scheme, gave rise to a breach of the European Convention on Human Rights 1950 art.6 was a highly fact-specific exercise which should be decided by the trial judge rather than by judicial review.
