The court used its inherent jurisdiction to grant declaratory relief authorising an NHS trust to carry out an elective caesarean upon a pregnant woman suffering from bipolar disorder, who had been detained in hospital under the Mental Health Act 1983. She lacked capacity to make decisions on the safe delivery of her baby, and the caesarian was in her best interests. The court permitted the minimum restraint deemed necessary to facilitate her treatment.
