Being at the front of the queue or first over the finishing line isn’t always the best place to be. For the first company entering into a Deferred Prosecution Agreement (DPA), a new tool for prosecutors which became available this week, it will be a mixed blessing. Certainly the first such agreement will attract significant publicity, as its details are scrutinised by the media, lawyers, company boards and other interested parties.
