DIRECTOR OF PUBLIC PROSECUTIONS (APPELLANT) v JOHN KAY (RESPONDENT) (1998)

PUBLISHED March 4, 1998
SHARE

Successful appeal by way of case stated against the dismissal of an information. There was no bad faith by the police in failing to ascertain when the respondent last drank before conducting a breath test too soon after that last drink. That failure did not render the respondent's arrest unlawful and therefore the police evidence was admissible.
