Customs could bring an action for conspiracy against a Spanish company to recover payments made wrongly following a carousel or missing trader fraud. Unlawful means conspiracy was not limited to civil wrongdoing, breaches of contract and breaches of fiduciary duty. Neither was it limited to cases where there had been interference with trade or business.
