Fixed recoverable costs under CPR Part 45 were payable by the defendant whether or not the claimant was obliged to pay his own solicitor, and therefore whether or not the claimant's solicitor's retainer was valid, since the indemnity principle did not apply. However, the standard rules including the indemnity principle continued to apply to disbursements.
