The new Regime proposed for implementation in the Autumn will substantially change the way in which cases are listed in the Magistrates Court. It puts greater burdens on the CPS but the Court will expect more information from the Defence at the Case Management Hearing. The move is to use a Case Management hearing to extract admissions and move towards a Defence Case Statement scenario similar to that in the Crown Court. This lecture will point out the dangers for the Defence and suggest ways of ameliorating them.
