[2009] EWHC 2911 (Admin)

A costs order made by magistrates against a litigant who had brought an unsuccessful private prosecution could not be enforced under the Administration of Justice Act 1970 s.41(1) as if it were a fine. It was enforceable only as a civil debt pursuant to s.41(2).
