[2009] EWCA Crim 1003

A sentence of 21 months' imprisonment imposed on an offender for causing death by dangerous driving was arguably unduly lenient but was not altered, as although she had been using her mobile phone to make calls and to send, receive and read text messages during her journey, she had not used it at the time of the collision or immediately before it.
