The failure by the Crown to provide copies of statements made to the police by one of its witnesses had breached the appellant's right to a fair trial as he had been denied the opportunity to cross-examine the witness, whose evidence at trial was inconsistent with the statements made to the police, so as to undermine the witness's reliability and credibility.
