Where a vehicle had been seized and forfeited as a result of smuggling, the burden lay upon the appellant seeking restoration of the vehicle to demonstrate why the vehicle should be restored. The appeal tribunal in the instant case had given insufficient reasoning for dismissing the appellant's claim for restoration on the basis that it had found that she had knowledge of the purpose for which the vehicle was being used.
