It was appropriate for an interested party, a local authority, to be awarded its costs following a charity's unsuccessful judicial review of a magistrates' court's decision not to set aside a liability order made against it in its absence. The dispute was, in fact, between the charity and the local authority, rather than the magistrates' court, and the court did not seek its costs.
