Where there was a real risk that Rwandan nationals would suffer a flagrant denial of justice if they were returned to Rwanda to be tried for crimes of genocide before the High Court of Rwanda, the judge's decision to send their cases to the secretary of state and her consequent orders for their extradition were set aside.
