The courts of St Christopher and Nevis had been entitled to order the relevant magistrate to resume the hearing of the extradition proceedings against the appellants and to commit them under the Extradition Act 1870 s.10. The evidence came nowhere near establishing that they would be at risk of suffering a flagrant denial of justice were they to be extradited to the United States.
