Where the Road Traffic Act 1988 s.7(2) applied, the police were not required to explain to the suspect why a specimen of breath could not be taken. The suspect had been supplied with a sample of blood pursuant to the Road Traffic Offenders Act 1988 s.15(5) where it had been placed in her handbag whilst she was at the hospital.
