The failure expressly to allege or particularise dishonesty in a document in advance of the hearing of a charge of conduct unbefitting a solicitor constituted a procedural flaw. In bringing disciplinary charges against a solicitor the Law Society was under an obligation to give timely notice of an allegation of dishonesty with relevant particulars when appropriate, unless it was obvious from the nature of the charge.
