[2008] EWCA Civ 1138

A committal order made against a father who had abducted his son to Syria, and had then failed to effect his return to the United Kingdom in accordance with a court order, was set aside since no evidence had been adduced or findings made as to whether the father was in fact able to effect his son's return.
