When contemplating making a wasted costs order a judge should consider: (i) whether there has been an improper, unreasonable or negligent act or omission; (ii) whether costs have been incurred by a party as a result; (iii) if the answer to (i) and (ii) is yes then whether the court should exercise its discretion to disallow or order the representative to meet the whole or any part of the relevant costs, and if so what specific sum is involved.
