When taking account of previous convictions for the purpose of passing an automatic life sentence, the Powers of Criminal Courts (Sentencing) Act 2000 s.109(5) required the other serious offence to have been committed in England and Wales. Therefore an offence committed in Germany by an offender who had been serving in the British Army was not a qualifying offence.
