A sentencing judge had not been entitled to impose the minimum sentence of five years' custody provided by the Firearms Act 1968 s.51A(4), as inserted by the Criminal Justice Act 2003 s.287, in relation to an offender aged between 18 and 20, since that was contrary to Parliament's clearly expressed prohibition in the Powers of Criminal Courts (Sentencing) Act 2000 s.89.
