[2004] EWCA Crim 2107

A supporting prison officer who had overheard the defendant make incriminating remarks did not fall within the Police and Criminal Evidence Act 1984 s.67(9) and had not breached the Codes of Practice by failing to caution as the remarks were unsolicited and the officer was not involved in investigating an offence.
