R v RAK KOLI (2012)

PUBLISHED April 3, 2012

[2012] EWCA Crim 1869

The correct sentence for breach of a serious crime prevention order in circumstances where breach of notification requirements relating to mobile phones and a ThinkPad resulted from the offender's failure to take the order seriously rather than from an attempt to use them to commit further criminal activity, was 12 months' imprisonment. The fact that the breach had resulted in revocation of the offender's licence and his recall to prison was not a sufficient punishment in itself.
