When determining a defendant's cost order under s.16 Prosecution of Offences Act 1985 the court had to consider whether a privately-paying defendant had reasonably instructed the solicitor he did, not whether he could have instructed a solicitor charging a lower rate nor whether a lawyer of less experience would have been reasonably sufficient to conduct the case.
