[2008] EWCA Crim 373

A payment to a former spouse to satisfy an obligation under a divorce settlement, where that money was to be used to pay a mortgage on a jointly owned property, was not a gift for the purposes of making a confiscation order under the Criminal Justice Act 1988 .
