[2009] EWCA Crim 104

A judge had been entitled to retain a jury after having discharged one of its members following her non-participation, over a short period of time, in the jury deliberations. There was no risk in the circumstances that the eventual verdict would have been rendered unsafe by such non-participation of a single jury member.
