New case management powers enabled a judge to deal with issues preliminary to a trial by way of written submissions and to limit the length of those submissions. A judge was not bound to allow oral submissions. Principles relating to disclosure set out in the Protocol for the Control and Management of Unused Material in the Crown Court should be applied by trial judges and be familiar to counsel for defence and prosecution.
