[2012] EWCA Crim 2984

A suspended sentence of 40 weeks' imprisonment imposed on an offender for assaulting a police constable was quashed and replaced by a suspended sentence of five months' imprisonment because the sentencing judge had failed to appreciate that the maximum sentence he could impose for the offence was six months' imprisonment.
