EWCA Crim 820
A judge had correctly directed a jury to consider an indictment in the strict order that the counts appeared and that it should consider each count and each defendant separately. The counts did not stand or fall together on the basis of whether or not the jury believed the evidence of prosecution witnesses, as the jury had to consider the case as a whole, including evidence put forward on behalf of each defendant. The court gave guidance about the granting of certificates of appeal.
