[2009] EWCA Crim 810

Property that was the subject of forfeiture proceedings under the Proceeds of Crime Act 2002 s.298(4) was not excluded from the definition of "free property" in s.82 of that Act and could be taken into account for the purposes of assessing the recoverable amount under s.7.
