Once the court had assessed that a longer than commensurate sentence was appropriate to protect the public under s.2(2)(b) Criminal Justice Act 1991, a further period of imprisonment imposed at the same time consecutively was not justified. However, the principles in R v Walters (1997) 2 Cr App(S) 87 did not apply if on the facts of the offence the long sentence was correct without recourse to s.2(2)(b) of the 1991 Act.
