[2012] EWCA Crim 2437

A certificate made in confiscation proceedings which certified the value of an offender's proceeds from drug trafficking did not prevent subsequent prosecutions being pursued against other individuals who were said to have laundered proceeds of that trafficking which exceeded the value certified. Where a judge had decided to hold a preparatory hearing under the Criminal Procedure and Investigations Act 1996 s.29, he could not revoke his decision to make such a direction in the course of his ruling.
