Sentences of 15 months and 12 months' detention in a young offender institution imposed on two youths who had sprayed graffiti on railway carriages and other railway property, each causing over £10,000 of damage, were varied to conditional discharges on the basis that the offenders had served the equivalent of four months' detention, and because of the positive mitigation available.
