[2006] EWCA Crim 2849

There was no jurisdiction under the Criminal Justice Act 2003 s.58 to give the prosecution leave to appeal a judge's ruling made under the Crime and Disorder Act 1998 Sch.3 para.2 dismissing a charge of conspiring to cheat the revenue and quashing the relevant count in an indictment.
