While the court would have found that the disclosure in enhanced criminal record certificates, pursuant to the Police Act 1997, of warnings, convictions and cautions given to the subjects when they were children was incompatible with the European Convention on Human Rights 1950 art.8, it was constrained by the decision in R. (on the application of L) v Commissioner of Police of the Metropolis [2009] UKSC 3, [2010] 1 A.C. 410 to find otherwise.
